US Court Mandates Freedom of Abrego Garcia from Immigration Custody

A court has ruled the immediate discharge of Kilmar Abrego Garcia from detention by ICE, finding his ongoing confinement is without lawful basis.

"Since his release after erroneous detention in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis stated in her order.

The situation originates in a mistaken deportation to El Salvador earlier this year, which US authorities later admitted was an error. After his repatriation to the United States to answer alien smuggling allegations, he was detained in immigration custody.

In her order, the court pointed out that the government does not have a valid removal order, which prevents them from removing Mr. Abrego Garcia "at this juncture."

Context of the Case

The legal proceedings involve conflicting assertions. While the Trump administration argues that Abrego Garcia is a member of the MS-13 gang, he categorically denies this allegation.

He has also entered a not guilty plea to the smuggling counts, which are part of a separate criminal case in Tennessee.

The judge, who was hearing his petition to deportation in a Maryland district court, determined that he must now adhere to the terms of his bond from jail in Tennessee. This decision effectively transfers his supervision to the jurisdiction handling his criminal case.
